Workers compensation benefits may also include a lump sum payment under common law. An injured worker MAY BE entitled to a common law claim when there has been negligence or where an accident could have been PREVENTED. Common law does not apply under every jurisdiction.

Once an offer of a lump sum payment has been accepted you may not be entitled to a common law claim. If you accept a lump sum payment form WorkCover you may also sign away your common law rights. This means you may not EVER be entitled to pursue a claim under common law regardless of the circumstances. The rule of thumb is ‘Always seek a second opinion when accepting any offer of compensation from any insurance company’.
